What Is a Metropolitan District?
In accordance with Section 32-104.5(3)(X), C.R.S., the following general explanation of a metropolitan district in plain, nontechnical language, is provided. This information is intended to be read in conjunction with all applicable legal requirements, governing documents, agreements, resolutions, and determinations of the Board of Directors of the District.
1. A metropolitan district is a special district that provides any two or more of the following services:
(a) Fire protection;
(b) Mosquito control;
(c) Parks and recreation;
(d) Safety protection;
(e) Sanitation;
(f) Solid waste disposal facilities or collection and transportation of solid waste;
(g) Street improvement;
(h) Television relay and translation;
(i) Transportation; and
(j) Water.
2. In accordance with the District’s Service Plan, the District has the power and authority to provide, operate and maintain the public facilities and improvements (the “Public Improvements”), and has the power to provide ay and all services within the boundaries of the Districts as such power and authority is described in the Special District Act, and other applicable statutes, common law and the Constitution, as all may be amended from time to time subject to the following limitations:
(a) Fire Protection Limitation. The District will not be authorized to prove fire protection facilities or services, unless the facilities and services are provided pursuant to an intergovernmental agreement with the County. The authority to plan for, design, acquire, construct, install relocate, redevelop or finance fire hydrants and related improvements installed as part of the water system shall not be limited by this provision.
(b) Parks and Recreation Limitation. The Districts shall, as a supplement to, but not in duplication of the services and facilities now provided by the Western Eagle County Metropolitan Recreation District for Cordillera, its residents and taxpayers, design, acquire, install construct, operate and maintain public park and recreation facilities or programs including, but not limited to, swimming pools and spas, tennis courts, exercise facilities, bike paths, hiking trails snowshoe trails, pedestrian trails, pedestrian bridges, pedestrian malls, public fountains and sculptures, are and botanical gardens, equestrian trails and centers, picnic area, skating areas and facilities, ski-ways, common areas landscaping and weed control, outdoor lighting of all types, community events and other facilities and services, together with all necessary, incidental facilities, land and easements, and all necessary extension of and improvement to said facilities and systems.
The District provides the following ongoing services: operation and maintenance services for all public improvements owned by the District.
3. In accordance with the District’s Service Plan the total amount of debt the District can incur to provide and pay for public infrastructure is:
The District’s Service Plan does not limit the amount of debt the District can incur.
4. In accordance with the District’s Service Plan, the following revenue may be used to pay for the District’s debt:
The District may impose a mill levy on taxable property within its boundaries as a primary source of revenue for repayment of debt service and for operations and maintenance. The District may also rely upon various other revenue sources authorized by law. At the District’s discretion, these may include the power to assess fees, rates, tolls, penalties, or charges.
5. In accordance with the District’s Service Plan, the maximum mill levy that the District may assess to pay for its debt is as follows:
The District’s Service Plan does not provide for a maximum mill levy that the District may assess to pay for its debt.
6. Residents within the District may serve on the Board of Directors of the District if they are eligible electors of the District. A resident is an eligible elector of the District if the resident lives within the boundaries of the District and is registered to vote in Colorado.
